1. Services Provided

Aviary Digital specializes in creating bespoke digital portfolios, showcasing creative work, providing online presence management, and professional branding services. Our goal is to empower creatives and professionals by presenting their work in a compelling and effective manner.

2. User Responsibilities

• You are responsible for providing accurate, complete, and up-to-date information for your digital portfolio and branding.

• You must ensure that all content submitted to Aviary Digital (including text, images, videos, and other media) does not infringe upon any third-party intellectual property rights.

• You agree not to use our online platform for any unlawful or prohibited activities.

3. Intellectual Property

• All bespoke design elements created by Aviary Digital for your portfolio, upon full payment, become your property. However, Aviary Digital retains the right to use such work for promotional purposes as part of our own portfolio unless otherwise explicitly agreed.

• The content you provide for your portfolio remains your intellectual property, and you grant Aviary Digital a non-exclusive, worldwide, royalty-free license to display this content on our platform for the purpose of rendering services to you.

• The Aviary Digital name, logo, and the intellectual property associated with our online platform and service frameworks are owned by Aviary Digital and may not be used without prior written permission.

4. Payment Terms

• All fees for services rendered by Aviary Digital are as agreed upon in the individual project proposal or service agreement.

• Payment schedules and methods will be detailed in your service agreement. Failure to adhere to payment terms may result in the suspension or termination of services.

5. Confidentiality

Aviary Digital understands the sensitive nature of your creative work and professional data. We commit to maintaining the confidentiality of all information provided by you, except where the disclosure is required by law or necessary for the performance of our services, in which case we will aim to inform you where legally permissible.

6. Disclaimer of Warranties

Our services are provided "as is" and "as available" without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Aviary Digital does not warrant that our online platform will be uninterrupted, error-free, or secure.

7. Limitation of Liability

In no event shall Aviary Digital, its directors, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use our services; (ii) any conduct or content of any third party on our services; (iii) any content obtained from our services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

8. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Delhi, India.
